Chairman Doug Alderman called the meeting to order and reviewed the agenda.

 

March 19 Meeting Minutes

There was an addition to the meeting minutes.  Add chapter 7 for discussion in addition to other rules.  The word “distributed” was spelled incorrectly.  A motion was passed to approve the minutes as amended.

 

Proposed Rule Changes – Chapters 4-6

The committee reviewed chapters 4-6 from the March 19 meeting with the following actions:

A single page which was dated  3/26/03 was distributed to the committee to clarify definitions for “production area” and for “manure storage or treatment”.  This is to be included in House Bill 152.

 

Definitions

901:10-1-01            Reworded design capacity.

Livestock manure applicator was reworded.

Significant capital expenditures  was reworded; proposed to combine #6&7 together because they are both 4 cents.

                        Approved with changes as amended.

901:10-1-06       Certified livestock manager – changes to be made on language.  Tabled.  Discussion of certification program.  ODA is using certification programs administrated by NRCS and other states.

901:10-1-07       Review compliance certification – Consensus to approve as amended, with one agree to disagree (Dan Binder will submit paperwork supporting his views).

901:10-1-10       ProhibitionsTabled until we collect further comments and rewrite.

 

901:10-2-04       Manure storage treatment facility – approved.

901:10-2-06            Manure storage pond and manure treatment lagoon – approved.

901:10-2-08       Contents of the manure management plan: inspections, maintenance and monitoring – approved.

901:10-2-11       Contents of the manure management plan:  distribution and utilization methods – consensus to adopt with changes discussed.

901:10-2-20       Annual Report – consensus to adopt into rule with addition of “NPDES.” 

 

901:10-3-01       Contents of an NPDES.  Discussion of replacing word “pollutants” to “manure” of the state.  Tabled.

901:10-3-02       Effluent limitations – discussion on BCT and BPT.  Consensus approved with changes.

901:10-3-03       Horses and Sheep – consensus with proposed changes.

901:10-3-07       Designated Operations – Approved but note discussion of “pollutants” to “manure.”
