The Ohio Soil and Water Conservation Commission will meet on February 27, 2018 at 1:45 p.m.* at the Renaissance Columbus Downtown Hotel, located at 50 North Third Street Columbus, OH 43215.

The Ohio Soil and Water Conservation Commission is a seven-member commission; which ensures Ohio counties are served by effectively administered and adequately supported soil and water conservation districts.

The Ohio Department of Agriculture will hold a public hearing for the purpose of accepting testimony on the proposed amendment made to Ohio Administrative Code 90:6-1-01. The rule is being amended to adopt the new edition (2018) National Institute of Standards and Technology (NIST) Handbook 44.

Public Hearing Notice: Poultry Animals

The Ohio Department of Agriculture will hold a public hearing for the purpose of accepting testimony on the proposed rescission of Chapter 901:1-15 of the Ohio Administrative Code. The rules in Chapter 901:1-15 of the Ohio Administrative Code outline rules pertaining to poultry animals moved within or imported into Ohio. Further, there are rules prescribing the report of flocks found diseased, investigations, and quarantines. The rules are up for five year rule review. In the midst of the review, it was determined that these rules are not necessary as there are other existing administrative code rules which state the same requirements.

Specifically, OAC 901:1-15-02 which outlines rules regarding the movement of poultry animals within Ohio and the importation of poultry can also be found in OAC 901:1-17-11 and OAC 901-1-18-05. Further, the Departments powers with regards to the investigation and quarantine of these animals found in OAC 901:1-15-04 and OAC 901:1-15-05 are also expressly stated in Chapter 941 of the Revised Code. In order to ensure the removal of duplicative code sections, these rules have been proposed to be rescinded.

Public Hearing Notice: Produce Safety

The Ohio Department of Agriculture will hold a public hearing for the purpose of accepting testimony on the proposed new rules found in Chapter 901:3-12 of the Ohio Administrative Code.

The rules in this package adopt the produce safety processes as set forth in Title 21 of the Code of Federal Regulations part 112. These regulations focus on setting standards for the production, harvest, and handling of fruits and vegetables, in an effort to reduce foodborne illnesses and to prevent microbial contamination associated with fresh produce. These rules contained in this package mirror federal regulations in order to allow Ohio’s producer growers to be able to ship all across the country.

The rules below have been reviewed in accordance with Chapter 119 of the Ohio Revised Code and are being proposed as being as follows:

OAC 901:3-12-01 incorporates by reference all the food safety regulations housed in 21 CFR 112.

OAC 901:3-12-02 amends the code of federal regulations adopted in OAC 901:3-12-01 to ensure that the proper terminology is used state wide. Specifically, we amend terminology used in the CFR to ensure that the terminology matches what is used other Ohio Revised Code sections.

OAC 901:3-12-03 sets forth the regulations housed in 21 C.F.R. part 112 which are deleted under the rules. The deleted portions relate to enforcement procedures which only apply to FDA and do not apply to the Department.

OAC 901:3-12-04 sets forth the regulations which are amended under the rules. Many of the amendments have been made to ensure that the correct terminology is accurate for the state of Ohio.

OAC 901:3-12-05 outlines the compliance dates associated with this rule. These dates correspond with the timeline for implementation as directed by the federal government.

OAC 901:3-12-06 establishes a voluntary registration. At the request of several farms, ODA has created a voluntary registration which would allow farms that are otherwise exempt to be inspected and regulated by ODA. These farms have indicated to ODA that their clients are requesting that they be inspected pursuant to these laws. ODA will work with these farms to ensure that they are properly regulated and thereby opening their businesses to a larger marketplace

Public Hearing Notice: Livestock Exhibitions

The Ohio Department of Agriculture will hold a public hearing for the purpose of accepting testimony on the proposed amendments made to Ohio Administrative Code 901-19-07.

OAC 901-19-07 requires that all exhibition sponsors require exhibitors to attend or complete a quality assurance program or pass an exam which indicates that the exhibitor has the requisite knowledge presented in the quality assurance program. The quality assurance program is a comprehensive educational program which focuses on the proper care and welfare of food animals. The majority of animals entered into livestock exhibitions are eventually sold and placed in food supply. Due to this eventual entry into the stream of commerce, the knowledge of food safety, nutrition, management, handling, and the environment are critical to the success of producing a safe and wholesome product. Therefore, it is essential that all exhibitors be required to participate in the quality assurance program.

The rule has been proposed to be amended to update the Appendix A to this rule. The Appendix is titled Food Animal Youth Quality Assurance Minimum Standards. The Appendix has been amended to clarify the Age & Participation portion of the document; clarifying that individuals that are 19 years of age on December 31st of the current year are eligible to participate in the junior fair shows. Further, the description of the program has been amended to give a stronger scope to the requirements of the Quality Assurance program.

The Commercial Dog Breeding Advisory Board will meet on March 28, 2018 at 1:30 p.m. at the Ohio Department of Agriculture Bromfield Building, Auditoriums A&B. The purpose of the meeting is to conduct regular business of the board, which is required to meet four times each year.

The Commercial Dog Breeding Advisory Board was created with the passage of Senate Bill 130 to advise the Director of Agriculture on the development of administrative rules governing high volume breeders and dog retailers.
