The Agricultural Commodity Advisory Commission will meet on Wednesday December 13, 2017 at 10:00 a.m. at the Ohio Department of Agriculture’s Plant Health Building (Building 23) Conference Room 101, 8995 East Main Street, Reynoldsburg, Ohio. The purpose of the meeting is to conduct regular business of the commission, which is required to meet three times a year.

Public Hearing Notice: Import Rules

The Ohio Department of Agriculture will hold a public hearing for the purpose of accepting testimony on the proposed amendments made to Chapter 901:1-17 of the Ohio Administrative Code.

The rules in Chapter 901:1-17 of the Ohio Administrative Code outline the importation of animals into the state. Pursuant to section 941.02 of the Revised Code, the Department, through the Chief of the Division of Animal Health, shall promote and protect the livestock, poultry, and other animal interests of the state, prevent the spread of dangerously contagious or infectious disease, provide for the control and eradication of such disease, and to cooperate with the United States department of agriculture in such work. The rules of this chapter meet this directive. More specifically, the rules outline the disease testing requirements as well as proof of ownership of all animals coming into Ohio. These rules are necessary in ensuring that all animals in the state of Ohio remain disease free.

The hearing will be conducted in accordance with Chapter 119 of the Revised Code. Any person affected by the no change rule package may appear and be heard in person, by his attorney, or both, may present his position, arguments, or contentions, orally or in writing, offer and examine witnesses, and present evidence tending to show that the no change rule package, if adopted or effectuated, will be unreasonable or unlawful.

Public Hearing Notice: Hog Cholera Biologics

The Ohio Department of Agriculture will hold a public hearing for the purpose of accepting testimony on the proposed amendments made to sections 901:1-7-05, 901:1-9-01, and 901:1-9-02 of the Ohio Administrative Code.

The rules in this package regulate hog cholera, also known as classical swine fever, in the state of Ohio. After stakeholder outreach it was determined that these rules are no longer necessary. Specifically, this disease has been eradicated from the United States since 1978. Any outbreak of this disease would be controlled by the federal government. Therefore, these rules shall be rescinded.

Ohio Administrative Code 901:1-9-01 outlines the use of classical swine fever biologics. The rule states that any use of the biologics must be used by a licensed veterinarian and reported to the Department.

Ohio Administrative Code 901:1-9-02 controls the sale of these biologics. According to the rule, all sales must be permitted by the Department and can only be made to licensed veterinarians. As this disease has been eradicated these sales have ceased. Therefore, the rule is not necessary.

Ohio Administrative Code 901:1-7-05 states that all cars, trucks, vehicles, chutes, pens, sheds, and premises which have contained swine found affected with classical swine fever or suspected of being affected shall be cleaned and disinfected under the supervision of the department or its authorized personnel. This rule is both duplicative and unnecessary. As the disease has been eradicated this situation has not occurred. Further, classical swine fever is on the dangerously contagious and reportable disease list in OAC 901:1-21-02. As such, any instance of this disease must be cleaned in accordance with Chapter 941 of the Revised Code.
