How do I get an auctioneer's
license?
If you are a resident of Ohio or licensed in a non-reciprocal
state, you must first serve a twelve-month apprenticeship, act
as a bid caller in twelve auctions, and attend an approved auction
school prior to making an application for an auctioneer's license.
If you are licensed in a reciprocal state, you must make an
application for an auctioneer license and provide a letter of
good standing from your state licensing board. If you are an
out-of-state applicant and you do not have a license in a reciprocal
state, you may apply for a one-time license.
What are the auctioneer license
fees and renewal fees?
An apprentice
auctioneer license fee is $100.00. The license year is July 1st
to June 30th annually. The renewal fee is $100.00. Effective July
1, 2005, auctioneer license fee for individuals or corporations,
partnerships or associations is $200.00 for a biennial license.
If an initial license is issued in the middle of the biennium
the license fee shall be $100.00. Licensees whose last or business
names begin with the letters A-J and X-Z shall renew their licenses
on odd numbered years. Licensees whose last or business names
beging with K-W shall renew their licenses on even numbered years.
The license renewal fees for special auctioneers and auctioneers
for 2005 shall be: for licensees with the last or business name
beginning with A-J and X-Z shall be $200.00 and licensees whose
last names or business names begin with K-W shall be $100.00.
The one time license fee is $500.00.
Do I need to purchase a surety
bond?
Effective July 1, 2003,
Ohio auctioneers are covered under the Auction Recovery Fund for
a maximum liability of $50,000. Those individuals who were licensed
prior to June 30, 2003, and who continue to renew in accordance
with 4707.10 will no longer be required to carry the surety bond.
However, new licensees who receive their license after July 1,
2003, will be required to carry a $25,000 bond or an irrevocable
letter of credit for a period of three years before joining the
recovery fund. Applicants for the one time auction license are
required to submit a $50,000 surety bond or irrevocable letter
of credit and are not eligible for participation in the Auction
Recovery Fund. Applicants for an auction firm license are required
to carry a $50,000 surety bond or an irrevocable letter of credit.
On the police waiver, what
if my police department does not have an official stamp or seal?
A written response on police department
letterhead will be sufficient if the police department does not
have an official stamp or seal.
How do I get an auction company
license?
An auction company license
is not available in the State of Ohio. A corporation, limited
liability company, association or partnership may apply for an
auctioneer license if fifty percent of the partners or members
are licensed auctioneers. A corporation must have fifty percent
of the board of directors and the CEO be licensed auctioneers
in order to qualify for the auctioneer license for the corporation.
Ohio has an auction firm license. An auction firm may provide
auction services but a licensed auctioneer must conduct the auction.
An auction firm must appoint a firm manager. The firm manager
must be someone within the company with a sufficient amount of
authority in the running of the business. This individual, if
not already licensed as an auctioneer under Chapter 4707.07, must
take and pass the firm manager examination prior to the license
being issued. The firm manager examination is given monthly on
the same day as the apprentice auctioneer exam.
Can an apprentice auctioneer
auction real property?
If the apprentice
auctioneer is licensed as a real estate broker or salesperson,
they may sell real property at auction if their sponsor is also
licensed as a real estate sales person or broker. An apprentice
auctioneer cannot sign an auction contract for the sale of real
property at auction.
How do I register a DBA or
doing business as?
If you are going
to operate as an auctioneer under a name other than your given
name, you must first register your DBA with the department. In
order to add a DBA to your license, you must first register with
the Ohio Secretary of State's Office under a trade or fictitious
name. The Secretary of State's Office will provide a certificate
once the name has been registered. Please forward a copy of the
certificate, your license and a $10 check to the Auctioneer Program
to have the DBA added to your license.
How do I find an auctioneer
in my area and how do I know if an auctioneer has had his/her
license suspended or revoked?
On the
Department of Agriculture's web site, there is a search feature
that allows you to search for an auctioneer by name or by county.
In the listing, the status of a license will be listed as either
active, suspended, or revoked. Click

history on an auctioneer, you may call the Enforcement Division's
Auctioneer Program at (614) 728-6240.
How do I file a complaint
against an auctioneer?
Complete and
mail the complaint form found at the ODA Auctioneer web site
at Ohio Department of Agriculture Auctioneer Home. Upon receipt
of a verified complaint, the department will investigate.
I am applying for a license in a reciprocal state. How do I get
a letter of good standing? You may request a letter of good standing
from the Auctioneer Program by calling (614) 728-6240, faxing
your request to (614) 728-6328, or sending an e-mail to auctioneer@agri.ohio.gov.
There is no charge for this service.
Can charity or benefit auctions
use non-licensed auctioneers to do the bid calling?
R.C. 4707.02 states that no auction shall
be conducted in this state except by a licensed auctioneer. There
are no provisions that would exempt a charity or benefit auction
from having to comply with this requirement. A celebrity or nonlicensed
individual may act as a ring person or may help the licensed auctioneer
spot bids but only a licensed auctioneer may call for bids at
an auction.
